Parsa

Parsa District, under province no. 2, in Terai (plain) region, one of the seventy-five districts of Nepal. The district, with Birgunj as its district headquarters, covers an area of 1,353 km² and has a population of 6,01,017. Annex 33 of annual report of FY 2070/2071 BS (2014/2015 AD) of Office of the Attorney General, reported 906 persons arrested (officially recorded number). As it has adjoined open India border, a high number of people get arrested for criminal charge(s). 5197 cases were registered in Parsa District Court out of which 1698 are criminal cases. Similarly 582 cases were registered before CDO and quasi-judicial bodies, with no proper guarantee for fair trial. Although there are several legal aid providers existing in Parsa district (e.g. District Legal Aid Committee, Baitanik Wakil, civil society organizations) however arrested persons are not getting proactive legal aid service guaranteed by constitution. DLAC is not functioning well, the clause to get certificate first from local authority for poverty makes detainees life more complex to get free service from DLAC. Baitnakil Wakil service is also not more effective. The data itself shows about the representation of Baitanik Wakil. Baitanik Wakil only represented 125 cases out of 1698 criminal cases, which is just 7.4 %.
PDS-Nepal is providing proactive legal Aid in this district from April 1, 2017.
